Application of Non-price Evaluation Criteria to Public Procurement in Ukraine: Role and Place of Forensic Economics

Abstract

This article is devoted to the administrative and legal aspects of reducing corruption risks when customers apply non-price criteria in public procurement. The purpose of the article is to summarize the theoretical provisions regarding the role and place of judicial economic expertise as a means of reducing corruption risks when customers use non-price criteria in public procurement, and to formulate practical proposals for reforming legislation in this area. To achieve this goal, a system of general scientific and special research methods was used: dialectical, legal modeling, statistical analysis, comparison, linguistic, formal-legal, economic-legal, etc. Statistical data and judicial practice on this issue were analyzed. A comparative analysis of the legislation of Great Britain, the European Union, and Ukraine was conducted. It was proposed to specify the mechanisms for applying non-price criteria (in particular, by obliging the customer to calculate the specific weight of non-price quality criteria and with a measurable economic impact). A scientific and legal assessment of the role and place of judicial economic expertise in the study of the application of non-price criteria by customers in public procurement is provided. Proposals for amendments to the draft law on public procurement are formulated.
