Survey as a Method of Scientific Cognition and Its Influence on the Formation of Forensic Road-Technical Examination Methodology

The research paper analyzes the main terms (concepts) related to methodology of forensic examination and the survey’s results of forensic experts. The research paper’s purpose is to analyze the methods of forensic examinations as a basis for developing algorithms for performing forensic examination tasks. Based on the survey results of forensic experts, the main provisions of organizing forensic examinations in general and forensic road-technical examination in particular have been determined, which will be useful for developing general methodological principals of road-technical examinations. It is claimed that methods and techniques of examination can be considered a particular specification of the cognitive method. Expert methodology is a combination of methods, techniques, and means of performing an expert task on one hand, and on the other hand, a special method of forensic examination. A complex of methods of scientific cognition (including general scientific methods) was applied to analyze the survey’s results. Due to the complexity and regulatory gaps in the provisions on complex expert examinations, changes to the regulatory legal acts have been proposed to establish the mechanism for formalizing the complex of examinations and comprehensive examination as different forms of integrating specific expertise. The issue of further development of forensic sciences has been considered. It is emphasized that knowledge of the theory of forensic science and procedural issues of conducting forensic activities is a guarantee of the proper level of professional training for forensic experts. The author’s definition of the concept of forensic science in criminal proceedings is provided, and proposals from forensic experts on improving the effectiveness of forensic activities are summarized.
