Forensic Classification of Criminal Offenses against Justice Administration

Abstract

Theoretical and applied aspects of forensic classification of criminal offenses against justice are disclosed. This research paper is to develop a forensic classification of criminal offenses against justice based on a comprehensive consideration of criminal law and forensically significant criteria. Research methodological basis is general scientific methods of analysis, synthesis and generalization, as well as dialectical, logical-semantic, formal-legal, systemicstructural, comparative-legal and hermeneutic methods. Current state of scientific research in the field of forensic classification of criminal offenses and scientific approaches to systematization of criminal offenses against justice is analyzed. Scientific positions are generalized and critical analysis of the proposed approaches is carried out. It is substantiated that use of exclusively criminal law criteria does not ensure full consideration of regularities of the mechanism of criminal and illegal activity, formation specifics trace picture and sources of evidentiary information. It was found that while constructing a forensic classification of criminal offenses against justice, mechanism of committing criminal offense, nature of the interaction of participants, methods of implementing illegal behavior, and the mechanism of trace formation are of paramount importance. An author’s forensic classification of criminal offenses against justice is proposed that includes seven independent groups of criminal offenses formed on the basis of forensically significant criteria. It is concluded that proposed classification model has important theoretical and applied significance, since it creates a basis for the formation of separate forensic methods of investigation and trial of the corresponding category of criminal offenses. Prospects for further research related to development of forensic recommendations and methods for individual types of criminal offenses against justice are outlined.
